We will schedule the exact date and time for your child's session after your deposit is received. I will personally reach out to you within 48 hours to finalize the details and confirm your session.

All deposits are collected through PayPal. You may check out as a guest on PayPal if you do not have a PayPal account.

*The Gallery is not recommended for children less than one year of age. Their attention span is not long enough to cooperate for extended periods of time and multiple outfit changes.

1. Fees and Payment. A deposit of $75.00 is collected to retain the photographer to perform services. The client shall pay a session fee or package fee at the time of session. The deposit shall be applied to reduce the total balance due the day of your session. The session fee covers the time and talent of photographer, basic retouching and creative editing of images, as determined by the photographer, and a proof gallery of images. Package fees include your session fee and a set number of images with print release. Additional editing outside of the basic retouching is available at an additional expense to be determined by photographer. Baby Grow Plan participants must pay 1/2 of the plan on or before the first session. The remainder of the plan balance is due on or before the second session. Baby Grow Plan pricing cannot be combined with other offers or coupons.

2. Photographer’s Standard Price List. The charges in this agreement are based on the photographer’s Standard Price List. This price list is adjusted periodically and future orders shall be charged at the prices in effect at the time when the order is placed.

3. Location and Fees. If there are any costs/fees associated with the location the client has chosen for their session, you, the client, will be responsible for those fees. The photographer will not guarantee or arrange payment on any location. Session fee covers travel within 15 miles of Whitsett, North Carolina. Any location outside of these limits shall be discussed with the photographer and may be subject to an additional charge of $25.00 plus $.52/mile.

4. Session Requests. *All newborn sessions must be completed within the first 14 days of life. Weekend appointments are available but are limited and subject to a $50.00 surcharge. *No cameras or any type of recording device (this includes cell phone cameras) are allowed during the session unless prior written agreement has been made between client and photographer. *Sessions start at the agreed upon time. It is strongly encouraged to arrive on time. If you arrive late for your session, your session time will be shortened.

5. Cancellation. If an illness or situation prevents a photo session from taking place, client may reschedule their session at least 1 calendar day prior to their shoot without penalty. Should client fail to give 24 hours’ notice, or decide to completely cancel the shoot, this deposit is forfeited and will not be refunded. The photographer reserves the right to reschedule due to illness, weather, equipment malfunction, or other circumstances beyond their control.

6. Reshoots. Reshoots are determined at the discretion of the photographer. Reshoots will not be given for poor choices of clothing, make-up, hair, weather-related issues, demeanor of the child, or by not following the recommendations of the photographer. Depending on the nature of the reshoot a fee may be associated.

7. Photographic Materials. All photographic materials, including but not limited to proofs and previews, shall be the exclusive property of the photographer. The photographer shall make proofs and previews available to the client for the purpose of selecting photographs. The photographer will make the proofs available on a secure password-protected website. The images will be available for viewing within 2-3 weeks of session date. During peak seasons turn-around times may be greater. Proofs will be available for 90 days. Orders should be placed within that 90 day time period. Should your gallery expire before an order is placed, there is a $40.00 reactivation fee to reactivate your gallery.

8. Ordering. Due to the custom nature of each session, all sales are final. Orders will not be processed until payment is received. Orders are fulfilled in the order in which they are received. Print orders are placed to our professional lab within 3 business days of your order. Digital packages and digital images are delivered by digital download and are available for 60 days. After 60 days there will be a $40.00 reissue fee.

9. Copyright and Reproductions. Melissa Ann Hébert Photography shall own the copyright to all images created during a session and shall have the exclusive right to make reproductions. The photographer shall only make reproductions for the client or for the photographer’s portfolio, samples, self-promotions, entry in photographic contests, or for display in the photographer’s studio. If the photographer desires to make other uses, the photographer shall not do so without first obtaining the written permission of the client. Additionally, print releases are purchased with digital files to print portraits for personal use. It is illegal to copy, scan, download, print, alter, or otherwise steal any image created by Melissa Ann Hébert Photography during client’s photo session. You will receive a watermarked image formatted for the web for use in online sharing for every image you purchase. You may also tag or give me photo credit when posting on social media.

10. Model Release. By signing this agreement the client consents that the photographs taken during the session may be used by the photographer for the purpose of display, portfolio, or advertising to promote the studio. Client further agrees that the images can be used without additional compensation to the undersigned.

11. Failure to Perform. If the photographer cannot perform this Agreement due to a fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to the photographer’s illness, then the photographer shall return the deposit to the client but shall have no further liability with respect to the Agreement. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the photographer. In the event the photographer fails to perform for any other reason, the photographer shall not be liable for any amount in excess of the retail value of the client’s order.

12. Inherent Qualities. Client is aware that color dyes in photography may fade or discolor over time due to the inherent qualities of dyes, and client releases photographer from any liability for any claims whatsoever based upon fading or discoloration due to such inherent qualities.

13. Liability. Photographer is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their children and for themselves and release photographer from any claims against their person or their business.

14. Arbitration. All disputes arising under Agreement shall be submitted to binding arbitration before a North Carolina arbitration attorney in the State of North Carolina and the arbitration award may be entered for judgment in any court having jurisdiction thereof. Notwithstanding the foregoing, either party may refuse to arbitrate when the dispute is for a sum less than $100.00.

15. Miscellaneous. This Agreement incorporates the entire understanding of the parties. Any modifications of this Agreement must be in writing and signed by both parties. This Agreement shall be governed by the laws of the State of North
Carolina.
